We've already had a long discussion about this. Which of course all the facts were put out. This tends to cause a lot of drama.

I'll try to find the other thread from last month and post the links again.

Duke University is NOT "just some report." If anything, it provides a more in-depth and intelligent discussion of the issue than some blogger's rant...

Once again, the Lunatic Fringe who believe the End of the World is at Hand, are making a hue and cry over a non-issue.

If you would like to read a more intelligent and reasonable explanation of the Orphan Works Bill, READ THIS.[...]

Many, MANY works are being lost forever because of currently outdated and obsolete restrictions from the current copyright laws.

Technology today makes image access easier than ever, but lack of responsibility by authors/creators, dooms many efforts to preserve/restore works. The Orphan Works Bill will actually benefit all artists in the long run, by providing reasonable access to the rest of the world at large for copyright materials [b]while respecting the legitimate interests of the author[b] by making more widely known the availability of "public domain" materials.

It is NOT "legitimatized theft of everything you have ever created." That is simple FEAR mongering.
Don't fall for it. Pay particular attention to the words "MAY," "MIGHT," and "POSSIBLY."
If you care enough about a work to publicly display it, then you should care enough to register it. It's a no-brainer. Images will NOT be "accidentally orphaned," nor will authors of works "lose control of their works." If you are responsible enough to register the work you've put so much time and effort into, you will have recourse if your images are used under the mistaken assumption they are "orphaned." You will be able to request that any usage cease, if you find your work misappropriated, the work cannot be "instantly" used, with "free usage" allowance taking up to 3 years...If you can't be responsible enough to keep track of your works through public registration databases, that is YOUR lack of responsiblity. That should not prevent access to all works due to the lack of effort of a few...

No one will be stealing images from your sketchbook, unless you willy-nilly make them available on the Net, without a means to contact you, like a real name and e-mail.

False Claims of Orphan Work Copyright would be subject to "substantial penalty." 'Nuff said.

Check out CreativeCommons.org. If you feel this is an issue that concerns you, take the time to read the FACTS, not just the hysterical hype being promoted by those too lazy to be informed, who start screaming "The sky is FALLING!" without taking the time to see that no, if anything, the sky is opening up...

Don't forward inane propaganda like that stupid article, unless you also forward the other side of the argument. Don't be led astray by the Doomsayers. In the end, you'll be glad you took the time to understand the issue, rather than go off half-cocked, thinking you're being victimized, when you are not.

Let me just throw this into the mix -

Meredith L. Patterson says . . .
"There's a bunch of FUD going around the internets today about orphaned works, thanks to this article by Mark Simon of Animation World Network. He's urging artists to write their Congresscritters about eeeeevil orphaned works legislation and screaming about how it will effectively invalidate copyright for everyone except big evil registrars.

The problem? There is no such legislation before Congress (there was a bill in 2006, but it was never voted on; Marybeth Peters of the Copyright Office recently spoke before a subcommittee, but that's not a bill), and Simon is flat-out wrong about every concern he raises.

I've distilled his article down to six key misconceptions, and explained why each is wrong. "

I thought this whole ordeal was confirmed to be bogus; From what I heard, it was proposed years ago, but never went ahead to anything more than that, so we need not worry about this.

Or so I hope.

Actually, there are now 2 bills, one before the Senate and one before the House, addressing the Orphan Works issue.

S. 2913: Shawn Bentley Orphan Works Act of 2008 (via THOMAS)

H.R. 5889: Orphan Works Act of 2008 (via THOMAS)

Radio Free Meredith, one of the blogs linked above, has some updated info. Also, info on Public Knowledge blog.
